Terms of Use
These Terms of Use ("Terms") govern your use of the Yellow Teeth mobile application (the "App") provided by Jorge Castillo Pérez ("we", "us"). By installing or using the App you agree to these Terms.
1. The App
The App provides an AI-generated teeth whitening routine based on a photo you supply. Generated routines are educational suggestions only and are not medical or dental advice. The App is not a substitute for examination, diagnosis, or treatment by a licensed dental professional. Consult your dentist before starting any whitening routine, especially if you have gum disease, sensitivity, or restorations.
2. Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your country, whichever is higher) to use the App.
3. Subscriptions and free trials
- The App offers auto-renewable subscriptions. The current options are Weekly, Monthly (where available), and Yearly. Prices are shown in the paywall in your local currency.
- Some plans include an introductory free trial. Unless cancelled at least 24 hours before the end of the trial, your subscription will automatically convert to a paid subscription at the standard price.
- Subscriptions auto-renew at the end of each period at the then-current price unless cancelled at least 24 hours before the end of the current period.
- You can manage or cancel your subscription at any time in Settings → Apple ID → Subscriptions on your device. Deleting the App does not cancel your subscription.
- Payment is charged to your Apple ID account. Refunds, where granted, are handled by Apple under their standard refund policy.
4. License
We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the App on Apple devices you own or control, subject to these Terms and to Apple's standard Licensed Application End User License Agreement (apple.com/legal/internet-services/itunes/dev/stdeula), which is incorporated by reference. In the event of a conflict, these Terms control unless prohibited by Apple's EULA.
5. Your content
You retain ownership of photos you submit. By submitting a photo, you grant us a limited license to process it via our AI providers solely to generate your routine. We do not retain the photo on our infrastructure after analysis. See the Privacy Policy for details.
6. Acceptable use
- Do not use the App for any unlawful purpose.
- Do not attempt to reverse engineer, decompile, or extract source code from the App, except where permitted by law.
- Do not submit photos of other people without their consent.
7. Disclaimers
The App is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. Results from following any routine vary by individual and are not guaranteed.
8. Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, consequential, special, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly. Our total liability for any claim arising out of or relating to the App will not exceed the amount you paid us in the 12 months preceding the claim, or USD 50, whichever is greater.
9. Termination
You may stop using the App at any time. We may suspend or terminate access if you violate these Terms. Provisions that by their nature survive termination (e.g., disclaimers, liability limits) will continue to apply.
10. Changes
We may update these Terms from time to time. Continued use of the App after a change constitutes acceptance of the new Terms. Material changes will be communicated via the App or App Store update notes.
11. Governing law
These Terms are governed by the laws of Spain, without regard to its conflict of laws principles. Any dispute will be resolved in the competent courts of Spain, unless mandatory consumer protection laws of your country of residence provide otherwise.
